Today's Procurement Professional is challenged to reduce costs, complete complex contract negotiations, and minimize risk - all with reduced resources and in record time! Sound familiar? How do we accomplish these tasks without a clear understanding of the legal implications of the contracts and agreements we enter into? Today most of us do not have the luxury of an in-house attorney to review all the agreements we complete on a regular basis. Buyers, Buyer/Planners, Purchasing Agents, Commodity Managers, anyone in the Supply Chain Organization will benefit from attending this seminar. This seminar will provide you with the tools needed to succeed in not only negotiating favorable contracts and agreements, but in keeping you and your organization out of litigation. Legal Issues, Contracts and Agreements Supply Management professionals often times may not be familiar with the legal environment in which they operate. This interactive seminar will provide an overview of the broad legal concepts that affect a buyer's work, including agency, contract law, The Uniform Commercial Code (Article 2), and federal anti-trust legislation. Emphasis will be on developing an overall understanding of the legal implications of a buyer's activities, including a focus on understanding and building successful contracts and agreements. Accountability, responsibility and authority will be considered. Attendees will become familiar with basic purchasing-related legal issues, clarify legal terms and jargon, and know when to seek legal help. In this seminar participants will learn more about: § Agency § Limitation of supplier’s liability § Service contracts and leases § Warranties § Risk of loss § Remedies § Contract formation § Major federal legislation Richard Weissman, Endicott College Assistant Professor teaches management courses for the School of Business and the Van Loan Graduate School.
